Au lieu d\u2019\u00eatre f\u00e9licit\u00e9e pour ses efforts, elle a d\u2019abord re\u00e7u un avertissement, puis a \u00e9t\u00e9 licenci\u00e9e sans pr\u00e9avis. <\/p>\n<\/div>\n<div data-hk=\"0000a104212000a22210\" class=\"Html-Block\" data-qa-article-content-text data-text-milestone-block>\n<h2>L&rsquo;affaire : que s&rsquo;est-il pass\u00e9 ?<\/h2>\n<p>La jeune Espagnole de 22 ans travaillait pour une entreprise de logistique. Selon son contrat de travail, son quart de travail commen\u00e7ait \u00e0 7 h 30. Leur travail consistait \u00e0 v\u00e9rifier les affectations de transport et d&rsquo;itin\u00e9raire cr\u00e9\u00e9es la veille. Selon l&#8217;employeur, il n&rsquo;y avait aucune activit\u00e9 avant le d\u00e9but du quart de travail.<\/p>\n<\/div>\n<aside data-hk=\"0000a104212000a222204\" data-qa-ad-slot class=\"Ad-Slot Ad-Slot-mobile Ad-Slot-hor Ad-Slot-FC\">\n<div class=\"Ad-Slot-FC-Container\">\n<div class=\"Ad-Slot-FC-Window\">\n<div id=\"ad-slot-mobile-hor-2\" data-orientation=\"hor\" data-index=\"2\" data-slot=\"ad-slot\" data-device=\"mobile\"><\/div>\n<\/div>\n<\/div>\n<\/aside>\n<div data-hk=\"0000a104212000a22230\" class=\"Html-Block\" data-qa-article-content-text data-text-milestone-block>\n<p>N\u00e9anmoins, le salari\u00e9 se pr\u00e9sentait r\u00e9guli\u00e8rement dans les locaux de l&rsquo;entreprise entre 6h45 et 7h du matin pendant des mois. L\u2019employeur a d\u2019abord r\u00e9pondu par des avertissements verbaux, puis par un avertissement \u00e9crit. La jeune femme n\u2019ayant pas modifi\u00e9 son comportement, elle a \u00e9t\u00e9 licenci\u00e9e. M\u00eame apr\u00e8s l\u2019avertissement, elle aurait continu\u00e9 \u00e0 se pr\u00e9senter plusieurs fois tr\u00e8s t\u00f4t.<\/p>\n<\/div>\n<div data-hk=\"0000a104212000a22240\" class=\"Html-Block\" data-qa-article-content-text data-text-milestone-block>\n<h2>Tribunal : \u00ab L\u2019ordre interne a \u00e9t\u00e9 troubl\u00e9 \u00bb<\/h2>\n<p>L&#8217;employ\u00e9e a fait valoir devant le tribunal que sa pr\u00e9sence pr\u00e9coce \u00e9tait une expression de son engagement. Si vous vous asseyez plus t\u00f4t dans la salle de repos et ne pointez pas avant le d\u00e9but r\u00e9gulier du travail, il est peu probable que vous risquiez d&rsquo;\u00eatre licenci\u00e9 sans pr\u00e9avis.
